August 19, 2006 at 1830 hours, Trooper First Class J. Edelen of the Maryland State Police responded to Plater Road, Wicomico, Charles County Maryland, for a report of a subject sitting under a tree selling narcotics. Upon TFC Edelens arrival, he observed several black males sitting on a picnic table under a tree.
Edelen made contact with William Jervon Butler, who was identified by his MD drivers license. While speaking with Butler, TFC Edelen detected a faint odor of marijuana on his clothes and the area where he was sitting. TFC Edelen observed in plain view just under Butler a green tube with two holes burnt in the top of it and he saw smoke emitting from the tube. The tube had an odor of burnt marijuana coming from it.
TFC Edelen also observed parked in the middle of the roadway in front of the house a red Buick bearing MD registration. Butler advised TFC Edelen it was his vehicle and a check through MILES and NCIC revealed that the vehicle was indeed registered to Butler.
TFC requested a K-9 to perform a scan. Corporal Cuyler responded with K-9 Ozzy. Corporal Cuyler conducted a scan of the vehicle which resulted in a positive alert. A search of the vehicle revealed a small baggie containing 4.5 grams of marijuana in the drivers door pocket. Further search of the vehicle revealed a box of Saran Wrap used to package CDS.
Further search of Butlers person revealed $1138 of U.S. Currency in his left front pants pocket. With the CDS, amount of currency and the paraphernalia used to package CDS, it is an indication of a CDS distributor and seller. Butler was placed under arrest and transported to the Charles County Detention Center pending a bond review. Butler was charged with the following: Possession of marijuana with intend to distribute, possession of marijuana and possession of paraphernalia.
